FA Compliance System Terms of Service

1. Service Description

The FA Compliance System is a professional financial advisory platform that provides automated compliance forms, AI-powered document processing, real-time risk assessment, and secure client management tools.

2. Subscription and Billing

By creating an account, you agree to a monthly subscription service billed at R 1,999.00 per month.

• Billing occurs monthly on the same date as your registration
• Payment is due in advance for each billing cycle
• Failed payments may result in service suspension
• Subscription can be cancelled with 30 days written notice

3. Professional Requirements

This service is exclusively for licensed Financial Service Providers (FSPs) operating under FSCA regulation.

• Valid FSP license required for account activation
• Compliance with all FSCA regulations and requirements
• Responsibility for accuracy of all submitted information
• Maintenance of professional indemnity insurance

4. Data Security and Privacy

Your data is protected by bank-grade security measures including AWS encryption and secure authentication.

• All client data encrypted in transit and at rest
• Compliance with POPIA and international data protection standards
• Regular security audits and monitoring
• No sharing of client data with third parties without consent

5. Service Level Agreement

• 99.5% uptime guarantee (excluding scheduled maintenance)
• 24/7 system monitoring and support
• Automated daily backups of all data
• Response to critical issues within 4 hours

6. Acceptable Use

Users must comply with all applicable laws and regulations. Prohibited activities include:

• Unauthorized access or sharing of credentials
• Uploading malicious software or content
• Using the service for illegal activities
• Attempting to reverse engineer or copy the system

7. Limitation of Liability

While we maintain high standards of service, our liability is limited to the monthly subscription fee. Users are responsible for maintaining appropriate professional indemnity insurance.

8. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination:

• Access to the system will be disabled
• Data export capabilities available for 60 days
• No refund for partial billing periods
• All confidentiality obligations continue

9. Updates and Changes

We reserve the right to update these terms with 30 days notice. Continued use of the service constitutes acceptance of updated terms.

10. Governing Law

These terms are governed by South African law and subject to the jurisdiction of South African courts.

We are committed to protecting your privacy in accordance with the Protection of Personal Information Act (POPIA).

• Data minimization - we collect only necessary information
• Purpose limitation - data used only for stated purposes

• Consent management - clear opt-in for all data processing
• Data breach notification within 72 hours if required

4. Data Security

5. Data Sharing

• Account data retained while subscription is active
• Compliance records retained as required by FSCA regulations
• Usage logs retained for 12 months for security purposes
• Deleted data purged from all systems within 30 days

Under POPIA, you have the right to:

• Request deletion of your data
